The agreement between you, the community, and us

Terms of Service

These terms govern your use of Wesaka. They are written to protect the communities first, the guests second, and the platform last — in that order. By using Wesaka, you agree to them. Last updated 31 May 2026.

Wesaka is operated by Pila Studio UG (haftungsbeschränkt), registered in Germany. By creating an account or otherwise using the platform, you enter into a binding agreement with us on these terms. If you do not agree, do not use Wesaka.

You must be at least 16 years old to use Wesaka, and old enough to form a binding contract in your country. You are responsible for the accuracy of the information you provide and for keeping your account secure. You may not share your account or impersonate another person or community.

Wesaka is a platform on which communities invite the world to witness their living traditions. Communities host events and set the terms of access; guests discover, apply to, and attend them; guides provide on-the-ground support; and ambassadors and partners help communities join. Wesaka facilitates these relationships — it is not the organiser of the events themselves, which remain the responsibility of the hosting community.

Wesaka exists to keep traditions alive, not to consume them. As a condition of use, you agree to:

Honour the host’s terms. Each event sets its own access tier and rules — including photography policy and conduct expectations. You follow them.

Respect the host veto. A community may close, restrict, or remove access to any event or participant at any time, immediately and without giving a reason. This is absolute.

Treat sacred events as sacred. Events marked sacred are not to be recorded, broadcast, commercialised, or shared except exactly as the community permits.

Behave as a guest. You will not harass, demean, or endanger any community, host, guide, or fellow witness, on or off the platform. Violation may end your access without refund.

Where events carry a fee, payment is processed by Stripe under their terms. The defining rule of this platform is the give-back: a minimum of 70% of ticket revenue returns to the host community. This is not a setting we can quietly change — it is enforced in our payment code. Sacred events carry no platform fee; the community keeps 100%.

Fees, taxes, and any applicable charges are shown before you confirm. Refund and cancellation terms for a given event are set in connection with that event; where a community cancels, we work to return your payment promptly. Because events are real cultural gatherings — not interchangeable products — availability, dates, and details can change, and we ask for the patience a guest would extend a host.

Cultural content belongs to the community. The events, the photographs, the recordings, and the cultural knowledge shared on Wesaka belong to the communities that host them. Nothing in these terms transfers that ownership to Wesaka or to any guest.

Your contributions.When you publish a witness journal, reflection, review, or upload media, you keep your rights in it, and you grant Wesaka a non-exclusive, worldwide, royalty-free licence to host, display, and distribute it on the platform for the purpose of operating Wesaka and preserving the cultural archive. You confirm you have the right to share what you upload, and that it respects the host’s photography and recording policy.

Our brand. The Wesaka name, marks, and platform design are ours. You may not use them except as the platform allows.

You agree not to misuse the platform — including by attempting to circumvent access tiers or anti-virality protections, scraping or harvesting data, uploading unlawful or infringing content, interfering with the platform’s security, or using Wesaka to exploit or commercialise a community’s culture without its consent.

Wesaka relies on third parties — including Clerk, Stripe, Beehiiv, and others — and may link to external services. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.

Wesaka is provided “as is” and “as available”. To the extent permitted by law, we do not warrant that the platform will be uninterrupted, error-free, or that any event will take place as described. Cultural events are organised by communities, and attendance carries the ordinary risks of travel and participation, which you accept.

To the fullest extent permitted by law, Wesaka is not liable for indirect, incidental, or consequential damages arising from your use of the platform. Nothing in these terms limits liability that cannot be limited under German law — including liability for intent, gross negligence, or injury to life, body, or health. Where our liability for ordinary negligence applies, it is limited to foreseeable damage typical for this kind of agreement.

You may close your account at any time. We may suspend or end your access if you breach these terms, misuse the platform, or harm a community or another user. On termination, the licences you have granted for content already published as part of the cultural archive survive to the extent needed to keep that archive intact.

These terms are governed by the laws of Germany, excluding its conflict-of-laws rules and, where it would deprive you of mandatory consumer protections, without prejudice to those protections. Mandatory consumer rights in your country of residence remain unaffected.

We may update these terms as the platform evolves. When we make material changes, we will update the date above and, where appropriate, notify you. Continued use after a change means you accept the revised terms.
